Davis & Cannon, LLP represents clients impacted by disabling personal injuries or death of a loved one. Frequently contacted by individuals throughout Wyoming, the attorneys carefully review and select the most serious, often catastrophic, cases to handle. We choose to commit our best efforts to fewer cases rather than many. Limiting the number of cases allows for the kind of in-depth understanding of both the technical issues involved in establishing liability and of the people whose lives have been irreparably damaged. For example, the firm has handled cases involving personal injuries arising from closed head brain injuries, severe burns and paralysis, as well as wrongful deaths.
Kim D. Cannon often takes the lead for the firm in these cases. Inducted as a Fellow in the International Academy of Trial Lawyers and recognized in Mountain West Super Lawyers and Best Lawyers in America in the area of personal injury, Mr. Cannon has served on the Board of Directors of the Wyoming Trial Lawyers Association (WTLA). Another attorney in the firm who works on these cases is Clint A. Langer.
Those who have suffered a serious injury or have lost a loved one to an injury are encouraged to contact the firm as soon as possible. Critical evidence must be gathered and witnesses identified immediately. The time during which a lawsuit may be brought – the statute of limitation, varies depending on the nature of the case. Actions for wrongful death must be brought within two years. Actions for personal injury must be brought within four years except for professional malpractice actions which must be brought within two years and actions against a governmental entity must begin with a proper claim being filed within two years and an action filed within one year after the claim. Great care must be taken to insure that the requirements of the claim procedure are met.
Initial Case Review
Our attorneys schedule meetings with the people who have suffered losses at the earliest possible opportunities. All initial case reviews are without any fee. Often these initial reviews may involve more than one meeting to gather and assess the medical records, as well as other relevant documents. Clients are encouraged to bring all documents to the initial review including all accident reports, technical information about the cause of the injury, photographs, medical records and income tax returns.
Case Development
Under Wyoming law an action may be brought against all the actors who may have contributed to the injury or death. Identifying and investigating the actions of those who may have caused the injuries or death requires the use of the best experts who are able to prepare reports and testify. Wyoming’s unique comparative fault system mandates a comparison of the “fault” of all the “actors” at trial regardless of whether the “fault” arises from negligence, products liability or breach of warranty. The firm employs the most qualified experts on the standard of care and the state of the art.
We also focus on developing a convincing damages case. Past and future medical bills, loss of earnings, pain and suffering, permanent disability and disfigurement and loss of enjoyment of life are some of the types of damages that may be recoverable in a serious personal injury case. In a wrongful death case, besides the economic loss, the focus is the loss of companionship, care and comfort of someone whose loss will be felt by the survivors for the rest of their lives.
Wrongful Death
Under Wyoming law, a tort claim for wrongful death must be brought by a representative appointed to represent the deceased. We have experience obtaining recovery for the family members who suffered a tragic loss due to the fault of another.
Medical Malpractice
Litigation regarding oil and gas production, mineral production, leasing, surface use agreements, and royalties often involve complex issues which are unique to energy production. With our extensive litigation experience and practical knowledge of the energy industry, we are well-equipped to advocate for our clients.
Mineral Ownership
Medical error can cause serious injury. Davis & Cannon, LLP, works closely with physicians and other medical experts to develop an in-depth knowledge of the medical treatment and problems that caused the harm.
Vehicle Accidents
Davis & Cannon, LLP’s personal injury lawyers have obtained verdicts and settlements in a variety of motor vehicle collision cases, from head-on collisions between passenger automobiles to highway accidents involving semi tractor-trailers.
Insurance Disputes
A number of our personal injury clients first approach us with concerns that they are not being treated fairly by an insurance company. Additionally, clients may have issues with their own insurance coverage, such as property damage payments, medical payments coverage, and health insurance claims processing. In the course of preparing a personal injury case, we advise clients regarding all sources of recovery for their losses.
